Privacy Policy

This Australian website is operated by Tonga Capital Pty Ltd (ABN 76 667 032 251), trading as Kika Sport, Ettalong Beach NSW. “We”, “us” and “our” refer to that operator. This policy explains how personal information is handled in connection with enquiries, orders, teamwear programmes and this website.

Our privacy framework

We are committed to handling personal information in accordance with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth). Statutory obligations under that Act apply to the extent that Kika Sport is an entity covered by it. This policy does not restrict any privacy rights available under applicable law.

Information collected and how it is obtained

Depending on your dealings with us, information may include your name, contact and delivery details; organisation or club; order, payment-status and transaction records; garment sizes and personalisation details such as names and numbers; artwork you provide; and correspondence, feedback and return requests. Website access may generate technical records such as IP address, browser details and pages requested. Payment providers collect the payment details needed to process your chosen payment method.

We collect information directly when you contact us or place an order, and may receive relevant team-order information from your club, school, nominated coordinator or representative. Only information reasonably necessary for the relevant purpose should be supplied. Please ensure that you have authority to provide information about others, including appropriate parent or guardian involvement for children. Do not send health or other sensitive information unless it is necessary and we have agreed a lawful way to handle it.

You may make a general enquiry anonymously or under a pseudonym where practicable. Without information needed to identify, produce, pay for or deliver an order, we may be unable to provide the requested service.

Purposes and disclosures

We use information to respond to enquiries, prepare quotes and artwork, manage approved rosters and sizes, produce and deliver orders, process payments, provide support and remedies, maintain business records, protect against fraud and meet legal obligations. We may disclose relevant information to service providers involved in production, payment processing, delivery, website hosting, business email and IT support; professional advisers; your nominated team-order coordinator where needed to administer that order; and authorities where required or authorised by law. We limit disclosure to the relevant purpose and apply appropriate confidentiality and security arrangements.

Overseas handling

Hosting, email, payment and other service providers may store or handle information outside Australia. The countries involved depend on the services used for your transaction; their locations have not yet been confirmed for publication. Contact us for information about the arrangements relevant to your enquiry or order. Where an overseas disclosure is subject to APP 8, we must take reasonable steps to ensure the recipient does not breach the APPs, unless a lawful exception applies, and may remain accountable for its handling. Using the website does not by itself waive those protections or amount to consent to an unprotected overseas disclosure.

Website technologies and marketing

Website and payment services may use cookies or similar technologies for necessary functionality and security. Your browser can restrict cookies, although this may affect functionality. This policy does not constitute consent to optional tracking; information about any optional analytics or advertising technologies must be provided when those services are introduced.

Marketing email and SMS must comply with the Spam Act 2003: we require valid consent, identify the sender and provide accurate contact details and a clear unsubscribe facility. You can withdraw marketing consent using that facility or by contacting us. Requests will be honoured within five working days, without a fee or requiring an account login. The unsubscribe facility remains functional for at least 30 days after the message. Essential order and service communications are distinct from marketing.

Security and retention

We take reasonable technical and organisational steps to protect information from misuse, interference, loss and unauthorised access, modification or disclosure. These include appropriate access restrictions and secure handling arrangements with service providers. No transmission or storage system is entirely risk-free. We keep information only for as long as needed for its purpose, legal record-keeping and resolving disputes, then take reasonable steps to destroy or de-identify it when no longer required, subject to lawful retention obligations.

Access, correction and complaints

You may request access to your personal information or correction of inaccurate, incomplete or out-of-date information under APPs 12 and 13. Use Contact us and ask for the person responsible for privacy. We may verify your identity proportionately and will respond within a reasonable period. If access or correction is refused on a lawful ground, we will explain the reason and available complaint options; you may ask us to associate a statement of the correction sought with the record.

For a privacy complaint, please describe what occurred and the outcome sought through the same contact channel. We will investigate and respond within a reasonable period. If unresolved, or if you are dissatisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC), subject to its jurisdiction and complaint requirements.

Data breaches and current reforms

We will assess suspected breaches and take steps to contain and remedy them. Where the Notifiable Data Breaches scheme applies, an eligible data breach must be notified to the OAIC and affected individuals as required by law. This generally concerns unauthorised access, disclosure or loss likely to cause serious harm where remedial action has not prevented that risk.

The statutory tort for serious invasions of privacy commenced on 10 June 2025 and provides a separate avenue for court remedies where its requirements are met; it is not administered by the OAIC. The additional APP privacy-policy transparency obligations for certain automated decisions commence on 10 December 2026, after this policy’s update date. They are not represented here as already in force. Any applicable disclosures must be reviewed before that commencement and before relevant systems are introduced.

Policy updates

We may update this policy as our operations or the law change. The latest version and its update date will be published here. Material changes to information handling will be communicated where required.
